Abstract : The cancellation of fictitious orders is a form of legal violation in the area of consumer protection under Law No. 8 of 1999. One common practice in online transportation services is when drivers ask consumers to cancel their orders through the app but still provide the service offline to avoid app fees. This study examines the forms of legal protection available to consumers against the practice of fictitious order cancellations by Maxim drivers in Banda Aceh and the legal consequences and penalties associated with such practices by Maxim drivers in Banda Aceh. This study employs an empirical legal methodology using a case study approach, which involves the collection of primary and secondary data. Research findings show that Maxim drivers frequently cancel orders to avoid app fees, yet the service continues to operate offline. The impact of these fictitious order cancellations is the loss of legal protection for consumers. Enforcement in such cases can be carried out through sanctions imposed by the app company on drivers who violate the terms of service, such as warnings, account suspensions, or termination of the partnership. In addition, consumers may also file complaints in accordance with the provisions of Law No. 8 of 1999 on Consumer Protection if they suffer losses as a result of order cancellations by online transportation drivers. However, law enforcement in cases involving order cancellations by online transportation drivers remains suboptimal due to a lack of oversight by app companies, as well as low consumer awareness regarding the need to report violations they experience. In addition, the penalties imposed on drivers are not considered to serve as a sufficient deterrent, so the practice of canceling orders to avoid app fees continues. Therefore, stricter oversight of ride-hailing companies, the imposition of firm penalties on drivers who violate the rules, and increased legal awareness among consumers are needed so that the practice of canceling orders through the app while still providing the service offline can be minimized and legal protection for consumers can be effectively enforced.
