ACCOUNTABILITY AND TRANSPARENCY IN THE HANDLING OF MONOPOLISTIC PRACTICES TO ENSURE LEGAL CERTAINTY AT THE KPPU MAKASSAR CITY OFFICE
(An Analysis from the Perspective of Siyasah Syar’iyyah)

This study aims to examine accountability and transparency in the handling of monopolistic practices by the Business Competition Supervisory Commission (KPPU) in Makassar and to analyze them from the perspective of Siyasah Syar’iyyah. The study focuses on three issues: the implementation of accountability and transparency in handling monopolistic practices, supporting and inhibiting factors, and the importance of accountability and transparency from the perspective of Siyasah Syar’iyyah. This research employs a qualitative method using sharia and normative approaches. Data were obtained through interviews, observations, and documentation related to the handling of business competition cases at KPPU Makassar. The findings indicate that KPPU Makassar implements accountability and transparency through internal examination mechanisms, case-handling procedures, supervision, and public disclosure in accordance with Law Number 5 of 1999. Supporting factors include institutional integration, the use of information technology, and information openness, while inhibiting factors include limited resources, the complexity of regional economic cases, and potential pressure in law enforcement processes. From the perspective of Siyasah Syar’iyyah, accountability (mas’uliyyah) and transparency (bayān) are essential principles for realizing justice (‘adl), legal certainty, and preventing arbitrariness and corruption.
