POLITICAL DYNASTIES IN INDONESIAN LEGISLATION FROM THE PERSPECTIVE OF SIYASAH DUSTURIYYAH

This study aims to analyze the regulation of political dynasties in Indonesian legislation, the forms of restrictions imposed on political dynasties, and political dynasties from the perspective of Siyasah Dusturiyah. The research problems focus on how political dynasties are regulated under Indonesian laws and regulations, how political dynasties are legally restricted, and how such restrictions are viewed from the principles of Siyasah Dusturiyah. This study employs a qualitative method with a library research design using a normative juridical approach and a sharia approach. Data were obtained through an examination of laws and regulations, Constitutional Court decisions, books, scholarly journals, and other relevant literature. The findings indicate that restrictions on political dynasties were previously regulated under Law Number 8 of 2015 but were annulled through Constitutional Court Decision Number 33/PUU-XII/2015 on the grounds that the provision was inconsistent with the 1945 Constitution, particularly regarding citizens’ constitutional rights and the principle of non-discrimination. Following the enactment of Law Number 10 of 2016, such restrictions are no longer explicitly regulated. From the perspective of Siyasah Dusturiyah, limiting political power is necessary to prevent the concentration of power and to promote justice and public welfare in the administration of government.
