Abstract

This article examines the effectiveness of election criminal law enforcement in the 2024 Legislative Election in Gorontalo City. Election crimes threaten election integrity, public trust, and democratic legitimacy. Therefore, its enforcement needs to be judged not only by the number of cases that reach the courts, but also by the quality of institutional procedures. This study aims to analyze the effectiveness of law enforcement of election crimes and identify the factors that influence them. This study uses a juridical-empirical method with a socio-legal approach. Primary data was obtained through interviews with Bawaslu, the Police, the Prosecutor's Office, and related informants, while secondary data was obtained from laws and regulations, election supervision reports, and academic literature. The findings of the study show that law enforcement of election crimes in Gorontalo City has been carried out through the formal mechanism of Bawaslu and the Integrated Law Enforcement Center or Gakkumdu Center. However, its effectiveness is still influenced by the constraints of proof, the fulfillment of formal and material requirements, the limitation of institutional authority, the short deadline for handling cases, inter-institutional coordination, and the legal culture of the community. This study concludes that the enforcement of election criminal law in the upcoming elections requires strengthening preventive supervision, legal education to the public, participatory supervision, witness protection, and more effective coordination of the Gakkumdu Center.
