Tenaga kerja merupakan bagian integral dari sistem produksi dan konsumsi yang memegang peran strategis, bukan hanya sebagai pelaku ekonomi, tetapi juga sebagai kekuatan utama dalam menjaga stabilitas dan keberlanjutan pembangunan nasional. Pelanggaran terhadap hak-hak pekerja masih kerap terjadi di berbagai sektor, termasuk sektor industri retail dan fashion yang saat ini berkembang pesat. Salah satu kasus yang menjadi perhatian publik terjadi pada tahun 2022 dan melibatkan PT Erigo Indonesia, sebuah perusahaan fashion lokal yang dikenal luas di kalangan anak muda. Dalam kasus tersebut, puluhan karyawan dilaporkan diberhentikan secara sepihak oleh perusahaan setelah ditemukan selisih data pada saat proses stock opname. Karyawan diberi dua pilihan yang sama-sama merugikan: mengundurkan diri atas kemauan sendiri atau membayar ganti rugi sebesar puluhan juta rupiah atas barang yang dianggap hilang. Penelitian ini bertujuan untuk mengkaji legalitas tindakan pemutusan hubungan kerja secara sepihak oleh PT Erigo Indonesia dalam perspektif hukum ketenagakerjaan Indonesia. Dengan menggunakan metode yuridis normatif, penelitian ini menganalisis ketentuan dalam Undang-Undang Cipta Kerja serta peraturan turunannya. Hasil penelitian menunjukkan bahwa pemberhentian yang dilakukan tanpa melalui prosedur bipartit dan mediasi bertentangan dengan asas perlindungan terhadap pekerja. Oleh karena itu, tindakan tersebut berpotensi melanggar hukum dan menimbulkan konsekuensi yuridis bagi perusahaan.

Abstract
The workforce is an integral part of the production and consumption system, playing a strategic role not only as an economic actor but also as a driving force in maintaining the stability and sustainability of national development. Violations of workers’ rights still frequently occur across various sectors, including the rapidly growing retail and fashion industry. One notable case that drew public attention occurred in 2022 and involved PT Erigo Indonesia, a local fashion company well known among young people. In this case, dozens of employees were reportedly terminated unilaterally by the company following discrepancies discovered during a stock opname process. The employees were presented with two equally disadvantageous options: resign voluntarily or pay tens of millions of rupiah in compensation for allegedly missing goods. This study aims to examine the legality of the unilateral termination of employment by PT Erigo Indonesia from the perspective of Indonesian labor law. Using a normative juridical method, this research analyzes the provisions of the Omnibus Law on Job Creation and its implementing regulations. The findings indicate that terminations conducted without bipartite negotiations or mediation procedures violate the principle of worker protection. Therefore, such actions may constitute a legal violation and could result in legal consequences for the company.
