Abstrak
Praktik jual beli cengkeh yang terjadi di desa Manyamba Kecamatan Tammerodo Sendana Kabupaten Majene dilakukan dari hasil Melise’. Kegiatan Melise’ merupakan kebiasaan yang dilakukan masyarakat desa Manyamba pada saat musim cengkeh tiba. Dimana, mereka pergi ke kebun milik orang lain dan memungut cengkeh yang sudah jatuh ketanah kemudian dikeringkan dan dijual kepada pembeli setempat. Praktik melise’ ini dilakukan tanpa adanya persetujuan dari pemilik pohon cengkeh dan hasilnya pun di nikmatinya sendiri tidak dibagi kepada pemilik pohon cengkeh. Sehingga dikhawatirkan akan terjadi sengketa dikemudian hari.Rumusan masalah dalam yaitu : Bagaimana praktik melise’ di Desa Manyamba Kec. Tammerodo Sendana Kab. Majene dan Bagaiamana pandangan hukum Islam tentang jual beli cengkeh hasil melise’ di Desa manyamba Kec. Tammerodo Sendana Kab. Majene. Penelitian ini bersifat tinjauan lapangan (field research) dan menggunakan metode penelitian kualitatif. Pengumpulan data pada penelitian ini menggunakan metode wawancara, observasi dan dokumentasi. Jual beli cengkeh hasil melise’ di Desa Manyamba Kec. Tammerodo Sendana Kab. Majene sesuai dengan kondisi apabila pemilik merelakan maka jual belinya sah dan hasilnya halal, namum jika pemilik tidak rela maka jual belinya tidak sah dan hasilnya haram begitupun dengan hasil mengambil cengkeh yang masih berada diatas pohon tentunya jual belinya tidak sah begitupun dengan hasilnya haram untuk dimanfaatkan karena kegiatan ini sama saja dengan tindakan pencurian.

Abstract
The practice of buying and selling cloves that occurred in Manyamba Village, Tammerodo Sendana District, Majene Regency was carried out from Melise's produce. The Melise' activity is a custom carried out by the people of Manyamba village when the clove season arrives. Where, they go to other people's gardens and pick up cloves that have fallen to the ground and then dry them and sell them to local buyers. This practice of melise' was carried out without the consent of the owner of the clove tree and the results were enjoyed by himself and not shared among the owner of the clove tree. So that it is feared that there will be disputes in the future. The internal problem formulation is: How is the practice of Melise' in Manyamba Village, Kec. Tammerodo Sendana Kab. Majene and How is the view of Islamic law regarding the buying and selling of cloves produced from Melise' in Manyamba Village, Kec. Tammerodo Sendana Kab. Majene. This research is a field research and uses qualitative research methods. Collecting data in this study using interviews, observation and documentation. Sale and purchase of cloves from Melise' in Manyamba Village, Kec. Tammerodo Sendana Kab. Majene is in accordance with the condition that if the owner gives up then the sale and purchase is legal and the result is lawful, but if the owner is not willing then the sale and purchase is not valid and the result is illegal and the result is illegal as well as the result of taking cloves that are still on the tree of course the sale and purchase is not legal as well as the results are illegal to use because this activity is tantamount to an act of theft.
