Abstract

The establishment of the Regional Regulation of Bojonegoro Regency on Smoke-Free Areas (SFA) constitutes a strategic legal measure to protect the public’s right to health and to realize a healthy and sustainable living environment. The high level of exposure to cigarette smoke in public spaces, healthcare facilities, educational institutions, and other public facilities indicates the need for firm and comprehensive regulation at the regional level. This study aims to analyze the urgency of establishing a Smoke-Free Areas Regulation in Bojonegoro Regency from philosophical, juridical, and sociological perspectives. The research employs a normative legal method using statutory and conceptual approaches. The findings show that the establishment of the SFA Regional Regulation has a constitutional basis in the 1945 Constitution of the Republic of Indonesia, is consistent with Law Number 17 of 2023 on Health, and falls within the authority of regional governments in the health sector.
