DESAIN KEWENANGAN BAWASLU DALAM PENYIDIKAN UNTUK MEWUJUDKAN REFORMASI HUKUM PIDANA PEMILU

Abstrak
Penelitian ini mengkaji kedudukan Sentra Penegakan Hukum Terpadu (Gakkumdu) serta desain kewenangan Badan Pengawas Pemilu (Bawaslu) dalam penanganan dugaan tindak pidana pemilu di Indonesia. Gakkumdu, sebagaimana diatur dalam UU No. 7/2017, berfungsi sebagai forum koordinasi antara Bawaslu, Kepolisian, dan Kejaksaan guna mewujudkan penegakan hukum pemilu yang terpadu. Namun, dalam praktiknya masih terdapat kendala, terutama karena keterbatasan kewenangan Bawaslu yang belum memiliki fungsi penyidikan secara mandiri, sehingga berpotensi menimbulkan keterlambatan dan ketidakefisienan dalam penanganan perkara. Penelitian ini menggunakan penelitian hukum yuridis normatif, yaitu dengan menganalisis data sekunder dan bahan-bahan kepustakaan yang relevan. Hasil penelitian menunjukkan pentingnya penguatan kewenangan Bawaslu melalui pemberian fungsi penyidikan, sebagaimana dimiliki oleh Komisi Pemberantasan Korupsi (KPK) yang memiliki penyidik sendiri. Langkah ini diharapkan dapat mempercepat proses penanganan tindak pidana pemilu, meningkatkan independensi kelembagaan, serta meminimalisir potensi intervensi eksternal. Dengan demikian, sinergi antara fungsi koordinatif Gakkumdu dan penguatan kewenangan penyidikan Bawaslu menjadi kunci dalam mewujudkan sistem penegakan hukum pemilu yang efektif, akuntabel, dan berintegritas, serta memperkuat kualitas demokrasi di Indonesia.

Abstract
This study examines the institutional position of the Integrated Law Enforcement Center (Gakkumdu) and the design of the Election Supervisory Body’s (Bawaslu) authority in handling alleged electoral criminal offenses in Indonesia. Gakkumdu, as regulated under Law Number 7 of 2017, functions as a collaborative forum involving Bawaslu, the Police, and the Prosecutor’s Office to ensure coordinated and integrated enforcement of electoral criminal law. Despite its strategic role, the current mechanism still faces challenges, particularly due to Bawaslu’s limited authority, which does not extend to conducting independent investigations. This limitation often leads to inefficiencies, delays, and potential inconsistencies in law enforcement processes. This research employs a normative juridical legal method, which is conducted by analyzing secondary data and relevant legal literature. Through this approach, the study highlights the need to strengthen Bawaslu’s institutional authority by granting it investigative powers, similar to those held by the Corruption Eradication Commission (KPK), which operates with its own investigators. Such reform is expected to accelerate the handling of electoral crimes, enhance institutional independence, and minimize external intervention. Ultimately, the integration of Gakkumdu’s coordination function with an expanded investigative authority for Bawaslu is essential to build a more effective, accountable, and independent electoral law enforcement system, thereby reinforcing the integrity and credibility of democratic processes in Indonesia.
