TINJAUAN ASAS PEMILIKAN AMWAL DIDALAM KOMPILASI HUKUM EKONOMI SYARIAH TERHADAP PELAKSANAAN KONSINYASI PENGADAAN TANAH YANG BERSTATUS SENGKETA (STUDI PUTUSAN NOMOR 1/PDT.P-KONS/2025/PN RBG)

Abstrak
Pembangunan Saluran Udara Tegangan Tinggi (SUTT) 150 kV PLTU Rembang – Pati sebagai bagian dari Proyek Strategis Nasional (PSN) kerap menghadapi kendala berupa tanah sengketa, seperti kasus lahan seluas 394 m² di Kelurahan Sidowayah antara Desy Annisa dan Samuri. Guna menghindari risiko salah bayar dan kebuntuan proyek, PT PLN (Persero) menempuh mekanisme konsinyasi atau penitipan uang ganti rugi sebesar Rp286.812.300,- melalui Putusan Pengadilan Negeri Rembang Nomor 1/Pdt.P-Kons/2025/PN Rbg. Lembaga konsinyasi yang berasal dari Hukum Acara Perdata Barat ini menyisakan persoalan teoritis mengenai status hak milik jika dianalisis menggunakan Hukum Ekonomi Syariah. Penelitian ini bertujuan untuk menguji keabsahan dan implikasi pelaksanaan konsinyasi tanah sengketa tersebut berdasarkan ketentuan Amwal dalam Kompilasi Hukum Ekonomi Syariah (KHES). Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan kasus (case approach) menggunakan bahan hukum primer, sekunder, dan tersier. Hasil penelitian menunjukkan bahwa pelaksanaan konsinyasi ganti kerugian atas tanah sengketa telah memenuhi keselarasan dengan Asas Pemilikan Amwal dalam KHES. Kebijakan ini berhasil mengharmonisasikan Asas Ijtimaiyah (dimensi sosial) dan Asas Manfaat dengan mendahulukan ketahanan energi publik di atas kepentingan privat. Perlindungan hak keperdataan individu tetap dijamin secara utuh melalui Asas Amanah, di mana pengadilan berfungsi sebagai penerima titipan sah hingga sengketa kepemilikan berkekuatan hukum tetap. Meskipun terjadi pembekuan hak ekonomi sementara pada Asas Infiradiyah, mekanisme ini dinilai sebagai pilihan hukum paling adil demi kemaslahatan umum (al-mashlahah al-ammah).

Abstract
The construction of the 150 kV Rembang – Pati Extra High Voltage Overhead Line (SUTT) as part of the National Strategic Project (PSN) frequently encounters obstacles regarding disputed land, as exemplified by the 394 m² plot in Sidowayah Village contested between Desy Annisa and Samuri. In order to mitigate the risk of mispayment and project stagnation, PT PLN (Persero) pursued a consignment mechanism or the deposition of compensation funds amounting to Rp286,812,300,- through the Rembang District Court Decision Number 1/Pdt.P-Kons/2025/PN Rbg. This consignment institution, historically rooted in Western Civil Procedural Law, leaves profound theoretical questions regarding the status of property rights when analyzed through Islamic Economic Law. This study aims to examine the validity and implications of implementing land consignment under dispute based on the provisions of Book I Chapter III concerning Amwal (Property) in the Compilation of Islamic Economic Law (KHES). The research method employed is normative legal research with a case approach, utilizing primary, secondary, and tertiary legal materials. The results indicate that the implementation of compensation consignment for disputed land aligns with the Principles of Amwal Ownership in KHES. This policy successfully harmonizes the Principle of Ijtimaiyah (social dimension) and the Principle of Benefit (daf'u al-mafasid) by prioritizing public energy security over private interests. The protection of individual civil rights remains fully guaranteed through the Principle of Amanah (Trust), where the court functions as a legitimate custodian until the ownership dispute reaches a legally binding decision (inkracht). Although it triggers a temporary suspension of economic rights (mauquf) under the Principle of Infiradiyah, this mechanism is deemed the fairest legal alternative for the sake of the broader public interest (al-mashlahah al-ammah).
