Abstract

This study aims to analyze the role of mediators in resolving domestic disputes arising from infidelity based on social media evidence and to examine the position of such evidence in the mediation process. The research method used is an empirical juridical approach with a qualitative approach. Data were obtained through interviews with mediators and supported by a study of relevant laws and literature. The collected data were analyzed descriptively qualitatively to understand mediation practices and the use of social media evidence in resolving domestic disputes. The results of the study indicate that mediation has urgency as a more humane non-litigation mechanism in resolving domestic conflicts, especially those triggered by digital infidelity. In this context, social media evidence is recognized as valid electronic evidence in litigation, but in mediation it functions as a means of conflict clarification, not as an instrument of proving guilt. The mediator's role becomes increasingly complex because it must be able to manage the emotions of the parties, maintain neutrality, and place digital evidence proportionally. This study found that the success of mediation in cases of infidelity tends to be low due to high emotional conflict, a strong desire for divorce, and the absence of the parties. This study recommends strengthening mediator competencies, particularly in digital literacy and psychological approaches, to increase the effectiveness of mediation in the digital era.
