Legal Protection and Legal Certainty for Purchasers of State-Confiscated Movable Property
Resolving Regulatory Disharmony between Minister of Finance Regulation No. 122 of 2023 and National Police Regulation No. 7 of 2021

The execution of auctions for state-confiscated movable property serves as a legal instrument aimed at optimizing state asset recovery while providing legal certainty over assets confiscated based on court decisions with permanent legal force (inkracht van gewijsde). Problems arise when auction winners face administrative barriers in registering and transferring rights over auction objects due to the absence of original ownership documents, despite holding an Auction Minutes Summary (Kutipan Risalah Lelang) as valid evidence of acquisition. This study analyzes the form of legal protection for auction winners and examines the horizontal disharmony between Minister of Finance Regulation Number 122 of 2023 concerning Auction Implementation Guidelines and Indonesian National Police Regulation Number 7 of 2021 concerning Motor Vehicle Registration and Identification. By employing a normative legal research method with statutory and conceptual approaches, this study reveals that auction winners hold the status of good-faith buyers entitled to absolute legal protection and certainty. However, institutional ego and regulatory antinomy between the Ministry of Finance and the Indonesian National Police paralyze the transfer of rights at the operational level. Therefore, systematic synchronization and regulatory reform are urgently required to ensure the effectiveness of the legal rights of auction winners.
