This study aims to analyze the factors that cause the disparity in chemical castration criminal verdicts against perpetrators of sexual violence against children in Indonesia and examine these verdicts from the perspective of fiqh jinayah. This research is motivated by the difference in the application of additional penalties in the form of chemical castration in cases that have similar characteristics, thus raising questions about legal certainty and the effectiveness of child protection. The research uses normative legal research methods with a qualitative approach through a legislative approach, a case approach, and a fiqh jinayah approach. The main data source comes from the Mojokerto District Court Decision Number 69/Pid.Sus/2019/PN.Mjk, Surabaya District Court Decision Number 2627/Pid.Sus/2019/PN. Sby, Tuban District Court Decision Number 157/Pid.Sus/2020/PN.Tbn, and Tanjungkarang High Court Decision Number 42/PID/2021/PT. TJK which is analyzed together with laws and regulations and scientific literature. The results of the study showed that the disparity in verdicts was influenced by differences in the construction of the indictment, the judge's interpretation of the provisions of the chemical castration crime, the orientation of the purpose of the penalty, and the absence of sentencing guidelines that regulate the parameters of the application of the additional penalty. From the perspective of jiyah jurisprudence, the crime of chemical castration is a form of ta'zīr that is oriented towards the benefit and protection of offspring (ḥifẓ al-nasl), as long as its application meets the principles of justice and proportionality. This study emphasizes the importance of preparing penal guidelines to realize consistency of verdicts, legal certainty, and child protection.
