Abstract

This study examines how halaqah fiqh peradaban in Indonesian pesantren functions as a mechanism of comparative jurisprudential reasoning for harmonizing classical fiqh with Indonesia's national legal principles founded upon Pancasila. The study addresses two questions: (1) how comparative jurisprudential reasoning is constructed through halaqah deliberation; and (2) how this deliberative process contributes to the harmonization of Islamic jurisprudence with constitutional values and national law. Employing a qualitative socio-legal multi-site case study, data were collected through in-depth interviews, participant observation, and document analysis in three pesantren located in West Java and Central Java. The findings demonstrate that halaqah fiqh peradaban is not merely a forum for studying classical jurisprudence but an institutionalized process of legal harmonization. Comparative discussions among madhhab opinions are reconstructed through three interconnected stages: comparative interpretation of classical fiqh, contextualization using maqāṣid al-sharī‘ah and public benefit (maṣlaḥah), and harmonization with constitutional principles and Pancasila. This process enables pesantren scholars to preserve the authority of classical Islamic jurisprudence while responding to contemporary socio-legal challenges within Indonesia's plural legal system. The study proposes the Comparative Jurisprudential Harmonization Model (CJHM) as a conceptual framework explaining how pesantren integrate Islamic legal tradition, national law, and Pancasila without diminishing the integrity of either legal system. The findings contribute to contemporary debates on Islamic legal reform, legal pluralism, and the development of contextual Islamic jurisprudence in Indonesia.
