A Comparative Analysis of the Shāfiʿī and Mālikī Madhhabs

Abstract

This study examines Haji Gantarang as a local religious practice in the Selayar Islands Regency that has generated debate over its religious legitimacy from the perspective of Islamic law, particularly concerning normative hajj practices and the influence of local cultural traditions. The study aims to investigate how Haji Gantarang is understood from the perspectives of the Shāfiʿī and Mālikī madhhabs and how socio-cultural dynamics shape its religious legitimacy within local communities. This research employs a qualitative descriptive design, using participatory observation, in-depth interviews, and documentary analysis of classical fiqh literature and relevant academic sources. The data were analysed thematically through a comparative madhhab approach. The findings indicate that neither the Shāfiʿī nor the Mālikī madhhab recognises Haji Gantarang as a valid hajj ritual because it does not fulfil the tawqīfī requirements governing the prescribed places and rites of hajj in the Holy Land. Nevertheless, the two madhhabs differ in their interpretative orientations. The Shāfiʿī approach tends to emphasise a normative and restrictive assessment of ritual validity, whereas the Mālikī approach provides greater contextual space through the concept of ʿurf, allowing Haji Gantarang to be understood as a religio-cultural expression with educational and social value, provided that it is not regarded as a substitute for the obligatory hajj. These findings demonstrate that Haji Gantarang occupies a symbolic and pedagogical domain, reflecting an ongoing negotiation between Islamic legal norms and local cultural adaptation in shaping the religious experiences of Muslim communities.
