KESADARAN HUKUM MASYARAKAT TERHADAP PRAKTIK NIKAH SIRI DI KECAMATAN PALARAN KALIMANTAN TIMUR

The background of this research is the persistence of unregistered marriages in Palaran District, despite the government mandating marriage registration through statutory regulations. Some people believe that marriages are valid if they are conducted in accordance with religious requirements, even if they are not officially registered by the state. This situation demonstrates that public legal awareness regarding the importance of marriage registration still needs to be studied to understand the public's legal awareness regarding the practice of unregistered marriages in Palaran District and the factors that influence the practice. The type of research used in this study is empirical research with a case study approach. Data were obtained through interviews, observation, and documentation. Research informants consisted of officials from the Office of Religious Affairs (KUA), community leaders, and residents of Palaran District who were aware of or had been involved in unregistered marriages. The data obtained were analyzed using Soerjono Soekanto's theory of legal awareness, which includes legal knowledge, legal understanding, legal attitudes, and legal behavior. The results of the study indicate that, first, the legal awareness of the Palaran District community regarding the practice of unregistered marriages is still suboptimal. Some people are aware of the obligation to register marriages, but do not fully understand the importance of registration as a form of protection and legal certainty for husbands, wives, and children. In practice, society prioritizes the validity of marriages according to religion over state legal recognition. Second, several factors influence the practice of unregistered marriages, including social environment, economic factors, educational factors, religious understanding, and the perception that marriage administration procedures are quite complicated. These factors contribute to the persistence of unregistered marriages in the Palaran District community.
