KEWAJIBAN NAFKAH TERHADAP ANAK YANG TELAH BALIGH PASCA MENINGGALNYA IBU KANDUNG

Penelitian ini membahas kewajiban nafkah ayah terhadap anak yang telah baligh setelah meninggalnya ibu kandung, dengan fokus pada praktik penelantaran nafkah yang terjadi di Gampong Ujong Patihah Kecamatan Kuala Kabupaten Nagan Raya. Rumusan masalah penelitian ini adalah konsep nafkah anak yang telah baligh pasca meninggalnya ibu kandung serta praktik penelantaran nafkah anak dalam perspektif hukum Islam dan hukum positif di Indonesia. Jenis penelitian ini adalah penelitian kualitatif dengan pendekatan empiris. Data diperoleh melalui wawancara dengan aparatur gampong dan informan, serta studi kepustakaan yang meliputi Al-Qur’an, hadis, kitab fiqh dan peraturan perundang-undangan yang relevan seperti Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan, Kompilasi Hukum Islam dan Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak. Hasil penelitian menunjukkan bahwa kewajiban nafkah ayah dalam hukum Islam tidak hanya bergantung pada usia baligh, tetapi juga pada kemampuan anak untuk mandiri. Selama anak belum mampu mencukupi kebutuhannya, nafkah tetap menjadi tanggung jawab ayah. Di Gampong Ujong Patihah ditemukan penelantaran nafkah setelah ibu meninggal, terutama saat ayah menikah kembali. Hal ini bertentangan dengan hukum Islam dan hukum positif di Indonesia, sehingga diperlukan kesadaran hukum dan peran masyarakat untuk melindungi hak anak.

This study examines the obligation of a father to provide financial support (nafkah) to a child who has reached puberty (baligh) following the death of the biological mother, with a focus on the practice of neglect occurring in Gampong Ujong Patihah, Kuala District, Nagan Raya Regency. The research addresses two main issues: the concept of child maintenance after reaching puberty following the mother’s death, and the practice of neglect from the perspective of Islamic law and Indonesian positive law. This research employs a qualitative method with an empirical approach. Data were collected through interviews with village officials and informants, as well as through library research, including the Qur’an, hadith, classical fiqh literature, and relevant legal regulations such as Law Number 1 of 1974 on Marriage, the Compilation of Islamic Law, and Law Number 35 of 2014 on Child Protection. The findings indicate that, in Islamic law, a father’s obligation to provide maintenance is not solely determined by the child’s attainment of puberty, but also by the child’s ability to be self-sufficient. As long as the child is not yet capable of meeting their own needs, the responsibility of financial support remains with the father. In Gampong Ujong Patihah, cases of neglect were found after the mother’s death, particularly when the father remarries. This practice contradicts both Islamic law and Indonesian positive law, highlighting the need for greater legal awareness and community involvement in protecting children's rights.
