Abstract

Abstract

Legal certainty regarding advocates’ immunity rights constitutes a fundamental element in ensuring the independence and professionalism of the legal profession within a rule of law system. This study examines the normative framework governing advocates’ immunity rights, particularly as regulated in Indonesian law, and analyzes its implementation in legal practice. The research employs a normative juridical method by reviewing statutory regulations, legal doctrines, and relevant case law. The findings indicate that, although the legal basis for advocates’ immunity rights has been clearly stipulated especially in the Advocate Law its application often encounters challenges, including differing interpretations by law enforcement authorities and the persistence of criminalization against advocates in the course of performing their professional duties. This condition reflects a gap between normative guarantees and practical enforcement, thereby undermining legal certainty. Therefore, strengthening legal protection mechanisms, harmonizing interpretations among law enforcement institutions, and reinforcing professional ethics are necessary to ensure that advocates can perform their roles freely, independently, and responsibly without fear of undue legal repercussions.
